Essential terms
- 1.Each project receives a proposal describing the work, the price and the expected timeline.
- 2.Payment is made in two instalments: 50% at the start and 50% before publication or final delivery.
- 3.Work begins after receipt of the first payment and the necessary materials.
- 4.The first payment reserves the project and the production period. If the client decides to cancel after work has begun, the amount corresponding to the work already carried out is non-refundable. Exceptional situations are assessed on a case-by-case basis.
- 5.Hosting and other external costs, where applicable, are stated separately in the proposal.
- 6.The domain belongs to the client. The client's content and data remain the client's, and the essential accounts remain under the client's control.
- 7.Presença Digital Studio retains ownership of the templates, starters, generic components, tools, processes and reusable know-how used in development.
- 8.The Essential Website includes one round of changes. For other projects, the number of rounds is set out in the proposal, usually two. Changes are sent in an organised and consolidated form.
- 9.Later changes or significant changes to the approved structure are quoted separately.
- 10.Texts, images, videos, audio and documents are provided by the client, unless otherwise agreed.
- 11.The client is responsible for the accuracy of the content and for the corresponding usage rights.
- 12.The full writing of texts and the production or editing of images, videos, audio and documents are not included, unless agreed in advance.
- 13.The technical solution is defined according to the needs of the project and is described in the proposal, including any costs of external services.
- 14.The features available depend on the tool and plan chosen.
- 15.Support after delivery is limited to what is included in the proposal or in an ongoing support agreement.
- 16.The service does not include social media management, advertising, marketing strategy or any guarantee of commercial results.
- 17.The project will only be shown in the portfolio with the client's authorisation.
- 18.The applicable VAT regime will be clearly stated in each proposal and on the corresponding invoice, in accordance with the provider's tax status.
- 19.In each round of changes, the client has seven working days to send their comments in an organised and consolidated form. A lack of response may suspend the project and lead to a revision of the delivery date, but will not be considered automatic approval.
- 20.If the project remains for more than 30 days without the response, materials, approvals or payments required from the client, it will be considered suspended. Resumption will be subject to the availability at that time and may require a new timeline to be set. Work already carried out and costs incurred in the meantime remain payable. Any refund will be assessed according to the stage of the project, the work carried out and the applicable law.
- 21.The platforms, hosting services, domains, payment systems and other tools used are provided by third parties. Changes to the prices, features, policies or terms of these services, or periods during which they are unavailable, do not depend on Presença Digital Studio.
- 22.Where the client legally qualifies as a consumer, the mandatory rights provided for in consumer protection law apply.
- 23.In the event of any discrepancy between these general terms and a proposal specifically accepted for a given project, the specific terms clearly stated in that proposal prevail.
- 24.These terms are governed by Portuguese law.
